Rule of Law vs. Law and Order

Contrary to two generations of propaganda promoted by government officials of both major parties, the liberties, rights and freedoms guaranteed under the Unites States Constitution are not secured by the forces of Law and Order - whether military or civil; whether federal, state or local.

Rather, Law and Order is a pragmatic compromise to be applied as lightly and judicially as possible to support public safety. It is essential to understand the difference between the Rule of Law and Law and Order.

The Rule of Law represents the power and authority of The People over the government under their Constitution.

Law and Order represents the power and authority of government over The People in defiance of their Constitution.

In a free society, social unrest and public insurrection occur when the Rule of Law is suppressed by Law and Order - not the other way around. Recent events in the United States reflect this truth in no uncertain terms.

  • Excessive Law and Order in the form of militarized, Institutionalized and racially motivated police brutality sparked mass and sometimes violent protests.

  • The attempts of the incumbent administration to use the authority and power of the government to overturn the results of free elections led directly to violent attacks on government buildings and officials.

In a free society, the breakdown in Law and Order must inevitably follow the breakdown in the Rule of Law as surely as the fire follows the spark.

And only then does the real battle for the soul of the nation begin. Only then does a society choose which is more important, and whether The People or the Government will reign supreme.
